Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Humble Hunter website at humblehunter.co.za ("the Site") and any purchases made through it. By accessing the Site or placing an order you agree to be bound by these Terms. If you do not agree, please do not use the Site.

You may browse the Site without an account, but creating an account is required to complete certain purchases. You are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately at info@humblehunter.co.za if you suspect unauthorised use.

5. Products and pricing

We make every effort to display product information, images and prices accurately. However:

  • Colours and finishes may differ slightly from images due to screen and lighting variations
  • Stock availability is not guaranteed until your order is confirmed
  • Prices are displayed in South African Rand (ZAR) and are inclusive of VAT where applicable
  • We reserve the right to correct any pricing or product errors before dispatch, even after an order has been placed. If a price is corrected after payment, you may choose to proceed at the corrected price or receive a full refund.

6. Orders and acceptance

Your order is an offer to buy, not a binding contract. A contract is formed only when we send you a dispatch confirmation email. We may decline or cancel an order at our discretion, including but not limited to cases of:

  • Stock unavailability
  • Suspected fraud or unauthorised payment
  • Failure to meet age or licensing requirements
  • Pricing or product description errors
  • Delivery to a region we do not service

If we cancel an order after payment, you will receive a full refund within 5 to 7 business days.

7. Payment

We accept the payment methods displayed at checkout. Payment is processed by third-party payment providers and is subject to their terms. You confirm that any payment instrument you use is yours and has sufficient funds or credit available.

8. Shipping and delivery

Shipping is governed by our Shipping Policy. Risk in the goods passes to you on delivery to the address you provided at checkout. Title in the goods passes to you once we have received full payment.

9. Hunting products, licensing and lawful use

Certain products sold on the Site are intended for use in hunting, sport shooting or related outdoor activities. By purchasing from the Site you confirm and agree that:

  • You will comply with all applicable laws, including the Firearms Control Act 60 of 2000, the National Environmental Management: Biodiversity Act, and all provincial and national hunting regulations
  • Where a product requires a valid firearm licence, competency certificate, hunting permit or other authorisation, you hold the necessary authorisation and will provide proof on request
  • You take full responsibility for the lawful storage, transport and use of any product purchased
  • Humble Hunter is not liable for any misuse of products or for the consequences of any unlawful activity by the buyer

We reserve the right to require proof of licence or authorisation before dispatching certain items, and to cancel any order where such proof cannot be provided.

10. Returns and refunds

Returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

11. Intellectual property

All content on the Site, including text, images, logos, product descriptions, graphics, videos and the Humble Hunter trademark, is owned by or licensed to Humble Hunter and is protected under South African and international copyright and trademark law. You may not copy, reproduce, modify, distribute or use any content from the Site for commercial purposes without our prior written consent.

12. User content

If you submit reviews, comments, photos or other content to the Site, you grant Humble Hunter a non-exclusive, royalty-free, worldwide licence to use, reproduce, modify and display that content in connection with the Site and our marketing. You confirm that the content is your own, does not infringe any third-party rights, and is not unlawful, defamatory or offensive. We reserve the right to remove any content at our discretion.

13. Prohibited use

You may not use the Site:

  • For any unlawful purpose
  • To transmit viruses, malware or harmful code
  • To attempt to gain unauthorised access to the Site, its servers or related systems

You agree to indemnify and hold Humble Hunter harmless against any claim, loss, liability or expense (including legal costs) arising from your breach of these Terms, your misuse of the Site, or your unlawful use of any product purchased from us.

Your personal information is handled in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA).

18. Force majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including but not limited to load shedding, postal or courier disruptions, natural disasters, pandemics, war, civil unrest, strikes or government action.

19. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the Magistrate's Court or High Court of South Africa, as applicable.

20. Dispute resolution

Before pursuing legal action, you agree to first contact us at info@humblehunter.co.za and give us a reasonable opportunity to resolve the dispute. You may also refer consumer disputes to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission.

21. Changes to these Terms

We may update these Terms from time to time. The current version will always be available on the Site, with the "Last updated" date below. Material changes will be communicated by email to registered customers or by a notice on the Site. Continued use of the Site after changes constitutes acceptance.

22. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
